RESULTS WE ARE PROUD OF

EVERYTHING YOU NEED TO KNOW BEFORE APPLYING

01

What is a K-1 visa and what is it for?

The K-1 visa is a special immigration visa for the fiancé or fiancée of a US citizen. It allows entry into the United States for marriage. After the wedding you can apply for a Green Card and remain in the USA permanently.
02

Who can get a K-1 visa?

A person planning to marry a US citizen, who has personally met their partner within the last 2 years, is not married at the time of application, and intends to marry within 90 days after entering the USA.
03

Is an in-person meeting required before applying for a K-1 visa?

Yes. US law requires the couple to have met in person within the last 2 years before filing the petition. Online communication does not count as a personal meeting.
04

What is the I-129F petition and who files it?

The I-129F petition is an official document filed by the US citizen with USCIS as the first step for the partner to obtain a K-1 visa. Without an approved petition, applying for the visa is impossible.
05

How long does the I-129F petition take to process?

From 6 to 12 months depending on USCIS workload. This is the longest stage of the entire process. After approval the case is transferred to the embassy.
06

Can I enter the USA on a tourist visa and get married there?

Formally this violates the conditions of a tourist visa — entering the USA with the intention to marry and stay permanently. This may lead to deportation and a ban on entry. The correct path is a K-1 visa.
07

Is it mandatory to get married within 90 days?

Yes. The 90-day period is a strict legal requirement. If the marriage is not concluded within this period the visa becomes invalid and you must leave the USA.
08

What happens after marriage on a K-1 visa?

After the wedding an application for Adjustment of Status and a Green Card is filed. We also consult on this process — it requires additional documents and another interview.
09

How much does a K-1 visa cost?

The USCIS I-129F petition fee is $535. The embassy consular fee is $265. In addition there is the medical examination and our services starting from 600 EUR.
10

Is a medical examination required for a K-1 visa?

Yes. A medical examination by an authorized physician is mandatory. We help schedule the appointment with the correct doctor in Poland.
11

Can children come with a K-1 visa?

Yes. The applicant’s children may enter the USA on a K-2 visa. It is processed together with the K-1 visa — no separate petition is required.
12

What relationship evidence is required for a K-1 visa?

Chat history, joint photos, tickets and visas confirming personal meetings, financial transfers between partners, and recommendation letters from people who know the couple.
13

What if one of the partners was previously married?

You must provide a divorce certificate or death certificate of the previous spouse with an English translation. Previous marriages are not an obstacle to obtaining a K-1 visa.
14

Is an interview mandatory for a K-1 visa?

Yes. A K-1 visa always requires a personal interview at the embassy. The consular officer carefully checks the authenticity of the relationship and the seriousness of your intentions.
15

What are the main reasons for a K-1 visa refusal?

Insufficient proof of a genuine relationship, no evidence of an in-person meeting within the last 2 years, financial inability of the US fiancé or fiancée, or inconsistencies between documents and interview answers.
16

What should I do if I already received a K-1 visa refusal?

We determine the reason for the refusal and build a new strategy. We specialize in repeat applications — free reapplication is included in the cost of our services.
17

Does a residence permit in Poland affect the chances?

Yes. Legal status in Poland shows that you are law-abiding — this strengthens the application.
18

Can the consular officer doubt that the relationship is genuine?

Yes — this is one of the main risks for a K-1 visa. That is why it is extremely important to properly prepare relationship evidence and the interview.
19

How long does the entire process take from filing the petition to entering the USA?

On average from 12 to 18 months including USCIS petition processing, case transfer to the embassy, and visa issuance. That is why it is important to start the process as early as possible.
20

Can I apply for a K-1 visa while staying in Poland?

The I-129F petition is filed by the US citizen while in the United States. The applicant submits visa documents at the US Embassy in Warsaw or the Consulate in Kraków while staying in Poland.
